Deep Active Mind Terms of Use

These Terms of Use (“Terms”) govern your access and use of the Deep Active Mind website, mobile application, software, services, and any other related products and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Services. The Services are not available to children under the age of 13.
2. Account Creation
You may be required to create an account to access certain features of the Services. You are responsible for maintaining the confidentiality of your account credentials and are responsible for all activities that occur under your account.
3. User Content
You are solely responsible for any content you upload, post, or share on the Services (“User Content”). You retain ownership of your User Content, but you grant Deep Active Mind a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with the Services.
4. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in a way that could damage, disable, overburden, or impair the Services or any other server or network connected to the Services;
- Interfere with any other user’s use and enjoyment of the Services;
- Obtain or attempt to obtain unauthorized access to the Services or any related systems or networks;
- Collect or store personal information about other users without their consent;
- Engage in any unlawful activity or activity that violates the rights of others.
5. Intellectual Property
The Services and all content and materials included therein, including, but not limited to, text, graphics, logos, images, software, and designs, are the intellectual property of Deep Active Mind or its licensors. You are granted a non-exclusive, non-transferable license to use the Services for your personal, non-commercial use only.
6. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DEEP ACTIVE MIND DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR SECURE.
7. Limitation of Liability
DEEP ACTIVE MIND WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, AND PUNITIVE DAMAGES.
8. Termination
Deep Active Mind may terminate your access to the Services at any time, for any reason, without notice. You may also terminate your account at any time.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association.
10. Entire Agreement
These Terms constitute the entire agreement between you and Deep Active Mind with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
11. Changes to Terms
Deep Active Mind may modify these Terms at any time by posting the amended Terms on the Services. Your continued use of the Services following the posting of amended Terms constitutes your acceptance of the amended Terms.
