Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

• Account means a unique account created for You to access our Service or parts of our Service.
• Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
• Application means the software program provided by the Company downloaded by You on any electronic device, named ReCalAI, available on iOS App Store and Google Play Store.
• Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Deep Active Mind, 8205 Oakley Terrace, Zionville, IN 46077, United States.
• Content refers to content such as text, images, recipes, or other information that can be posted, uploaded, linked to or otherwise made available by You, regardless of the form of that content.
• Country refers to: Indiana, United States
• Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
• Free Tier refers to the basic version of the Service available at no cost with limited features.
• Guest User means a user who accesses the Service without creating an account, with limited access to certain features.
• Premium Subscription refers to the paid subscription service that provides access to additional features and unlimited usage.
• Service refers to the Application and Website.
• Terms and Conditions (also referred to as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• Third-party Service Provider means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service, including but not limited to Google Gemini AI, Supabase, and RevenueCat.
• Website refers to Deep Active Mind, accessible from https://deepactivemind.com
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Guest Access

You may browse certain features of the Service as a Guest User without creating an account. Guest Users can:

• Browse and explore public recipes in the Explore section
• Discover and view public communities
• Access Settings to customize appearance preferences (light/dark mode)
• View general app information and documentation

Guest Users cannot:

• Use AI-powered recipe scanning features
• Create, save, or manage personal recipes
• Join communities or participate in social interactions
• Like, comment, or rate recipes
• Access premium subscription features

By browsing the Service as a Guest User, You agree to be bound by these Terms and Conditions as they apply to guest browsing.

Registered User Access

Your access to and use of account-based features of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By creating an account or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 13. Users under the age of 18 must have parental or guardian consent to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

User Accounts

Account Creation

When You create an account with Us, You must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.

You may create an account using:

• Email and password - Create an account using your email address and secure password
• Google OAuth authentication - Sign in using your existing Google account (optional)
• Other authentication methods - We may offer additional sign-in options (such as Sign in with Apple) in future updates

All authentication methods limit data collection to your name and email address. Third-party authentication (such as Google OAuth) is entirely optional, and all features can be accessed using email and password authentication.

Account Responsibility

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

Service Description

ReCalAI is an AI-powered recipe management application that provides:

Core Features

• AI Recipe Scanning: Capture photos of food and receive AI-generated recipes powered by Google Gemini AI (requires account and available scans)
• Recipe Management: Create, edit, save, and organize your personal recipe collection (requires account)
• Community Features: Join communities, share recipes, comment, rate, and interact with other users (requires account)
• Search and Discovery: Find recipes by ingredients, categories, tags, and user preferences (guest and registered users)
• Collections: Organize recipes into custom collections and favorites (requires account)

Free Tier Limitations

The Free Tier includes limited AI scans per month (as configured by the Company). Once the free scan limit is reached, You must upgrade to a Premium Subscription to continue using AI scanning features.

Guest Users cannot access AI scanning features and must create an account to use this functionality.

Premium Subscription

Premium Subscription provides:

• Unlimited AI recipe scans
• Access to premium recipe templates
• Advanced community creation features
• Priority support
• Additional features as added by the Company

Subscription pricing and terms are displayed in the Application and on the Website. Subscriptions are billed on a recurring basis (monthly or annually) and automatically renew unless cancelled.

User Content

Your Content Rights

You retain all rights to the Content you post, upload, or share through the Service, including recipes, photos, comments, and other materials.

By posting Content on or through the Service, You grant Us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods now known or later developed, solely for the purpose of operating, providing, and improving the Service.

Content Responsibilities

You are solely responsible for Your Content and the consequences of posting or publishing it. By posting Content, You represent and warrant that:

• You own or have the necessary rights to use and authorize Us to use all Content You post
• Your Content does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of any person or entity
• Your Content does not contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable
• Your Content does not contain any viruses or malicious code
• Your Content does not violate any applicable law, regulation or rule

Prohibited Content

You may not post Content that:

• Infringes on intellectual property rights of others
• Contains false or misleading information
• Promotes illegal activities
• Contains harmful, threatening, or harassing material
• Impersonates any person or entity
• Contains spam or unsolicited advertising
• Violates any applicable laws or regulations

Content Moderation

We reserve the right, but not the obligation, to:

• Monitor and review User Content
• Remove or refuse to post any Content for any or no reason in our sole discretion
• Take any action with respect to any Content that we deem necessary or appropriate, including if we believe that such Content violates the Terms, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Service or the public, or could create liability for the Company

AI-Generated Content

AI Service Disclaimer

ReCalAI uses Google Gemini AI to analyze food photos and generate recipe suggestions. The AI-generated recipes are provided as suggestions only and may not always be accurate, complete, or suitable for Your specific needs.

Important Disclaimers:

• AI-generated recipes may contain errors or inaccuracies
• Always verify ingredients, measurements, and cooking instructions before preparing any recipe
• We are not responsible for any outcomes from following AI-generated recipes
• AI suggestions should be reviewed and modified based on your dietary needs, allergies, and preferences
• The AI may not detect all allergens or dietary restrictions in food photos

Your Use of AI Features

By using the AI scanning feature, You acknowledge and agree that:

• Recipe suggestions are generated by third-party AI and may not be perfect
• You will exercise Your own judgment when using AI-generated recipes
• You are responsible for verifying the safety and suitability of any recipe before preparation
• The Company is not liable for any harm, injury, or damage resulting from AI-generated content

Subscription and Payments

Subscription Terms

Premium Subscriptions are offered on a recurring basis (monthly or annually). By purchasing a Premium Subscription, You agree to pay the subscription fees indicated at the time of purchase.

Subscriptions automatically renew at the end of each billing period unless You cancel before the renewal date.

Payment Processing

Payments are processed through:

• Apple App Store for iOS subscriptions
• Google Play Store for Android subscriptions
• Third-party payment processors for web subscriptions

We do not store Your payment card information. All payment information is processed by these third-party providers according to their privacy policies and terms of service.

Cancellation and Refunds

You may cancel Your subscription at any time through:

• Your Apple App Store account settings (iOS)
• Your Google Play Store account settings (Android)
• Your account settings on our Website

Cancellations take effect at the end of the current billing period. You will retain access to Premium features until the end of Your paid period.

Refunds are handled according to the policies of Apple App Store, Google Play Store, or our payment processor. Generally, we do not provide refunds for partial subscription periods, but exceptions may be made at our sole discretion.

Price Changes

We reserve the right to change subscription prices at any time. Price changes will be communicated to You in advance, and You will have the opportunity to cancel Your subscription before the new price takes effect.

Intellectual Property

Company Property

The Service and its original content (excluding User Content), features and functionality are and will remain the exclusive property of Deep Active Mind and its licensors.

The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Deep Active Mind.

Limited License

We grant You a personal, non-exclusive, non-transferable, limited license to access and use the Service for Your personal, non-commercial use, subject to these Terms.

You may not:

• Reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission
• Modify, reverse engineer, decompile or disassemble the Application
• Create derivative works based on the Service
• Use any automated system to access the Service
• Remove any copyright or proprietary notices from the Service

Community Guidelines

When participating in communities and interacting with other users, You agree to:

• Be respectful and courteous to other users
• Share recipes and content that You have the right to share
• Respect the privacy of other users
• Not engage in harassment, bullying, or hate speech
• Not spam or post unsolicited advertising
• Follow the specific rules of each community You join
• Report inappropriate content or behavior to Us

Violation of community guidelines may result in removal of Your content, suspension of Your account, or permanent ban from the Service.

Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit, including:

• Supabase
• RevenueCat
• Apple App Store
• Google Play Store

Termination

Termination by You

You may terminate Your account at any time through our comprehensive account deletion process:

Account Deletion Process:

1. Navigate to Settings → Account → Delete Account in the Application
2. First Confirmation: You will be prompted to confirm your intention to delete your account
3. Second Confirmation: You must confirm again to proceed with permanent deletion
4. Immediate Deletion: Upon final confirmation, your account and all associated data are permanently deleted

What Gets Deleted:

• Your account credentials and authentication data (removed from Supabase Auth)
• All personal recipes (both AI-scanned and manually created)
• Community memberships and created communities
• All social interactions (likes, comments, ratings)
• Profile information and uploaded photos
• Subscription data (if applicable)
• All data removed from both our database and authentication systems

Important Notes:

• Account deletion is permanent and cannot be undone
• Cached or backup copies may persist for up to 30 days for technical reasons, then are permanently purged
• If you have an active subscription, we recommend canceling it before deletion (deletion does not automatically cancel billing through Apple or Google)
• Public posts you made in communities will be removed, but quoted content by other users may remain

Termination by Us

We may terminate or suspend Your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You:

• Breach these Terms and Conditions
• Violate community guidelines
• Engage in fraudulent or illegal activities
• Abuse the Service or other users
• Fail to pay subscription fees

Upon termination:

• Your right to use the Service will cease immediately
• Your access to Your account and Content may be disabled
• We may delete Your Content and account data
• Outstanding subscription fees may remain due

Effect of Termination

Upon termination of Your account:

• All licenses and rights granted to You in these Terms will immediately terminate
• You must cease all use of the Service
• Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

Limitation of Liability

Liability Cap

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You for the Service in the twelve (12) months preceding the event giving rise to the liability, or One Hundred US Dollars ($100.00 USD) if You haven't purchased anything through the Service.

Exclusion of Damages

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to:

• Damages for loss of profits
• Loss of data or other information
• Business interruption
• Personal injury
• Loss of privacy arising out of or in any way related to the use of or inability to use the Service
• Third-party software and/or third-party hardware used with the Service
• Damages resulting from AI-generated content or recipe suggestions
• Food-related injuries or illnesses from following recipes on the Service

This limitation applies even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

State Variations

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.

Without limiting the foregoing, neither the Company nor any of the company's providers makes any representation or warranty of any kind, express or implied:

• As to the operation or availability of the Service, or the information, content, and materials or products included thereon
• That the Service will be uninterrupted or error-free
• As to the accuracy, reliability, or currency of any information or content provided through the Service
• That the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components
• As to the accuracy, completeness, or safety of AI-generated recipes or content

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Food Safety and Recipe Disclaimer

IMPORTANT: USE RECIPES AT YOUR OWN RISK

ReCalAI provides recipe information and AI-generated recipe suggestions for informational and entertainment purposes only. The Company makes no warranties or guarantees regarding:

• The accuracy of recipe ingredients or measurements
• The safety or suitability of any recipe
• The presence of allergens in food
• Nutritional information accuracy
• Food safety or preparation methods

You are solely responsible for:

• Verifying all recipe information before use
• Checking for allergens and dietary restrictions
• Following proper food safety practices
• Ensuring recipes are suitable for Your needs
• Any consequences of preparing or consuming recipes from the Service

The Company, its employees, and its AI service providers are not liable for any illness, injury, allergic reaction, or other harm resulting from recipes obtained through the Service.

If You have food allergies, dietary restrictions, or health concerns, consult with a qualified healthcare professional before using recipes from the Service.

Indemnification

You agree to defend, indemnify and hold harmless the Company and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use and access of the Service
• Your breach of these Terms
• Your violation of any third party right, including without limitation any copyright, property, or privacy right
• Any claim that Your Content caused damage to a third party
• Your use of AI-generated content or recipes

This defense and indemnification obligation will survive these Terms and Your use of the Service.

Governing Law

The laws of the State of Indiana, United States, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

Informal Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company at privacy@deepactivemind.com.

Arbitration Agreement

If we cannot resolve the dispute informally, You and the Company agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration, rather than in court, except that You may assert claims in small claims court if Your claims qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its rules. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver

You and the Company agree that any proceedings to resolve disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which You are resident.

United States Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country
• You are not listed on any United States government list of prohibited or restricted parties

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Application, Website and the Service.
